1. Acceptance of Terms

By accessing diggerdemolition.com, requesting an estimate, scheduling a service, or submitting any inquiry, you confirm that you have read and agree to these Terms & Conditions. If you do not agree, discontinue use of this Site and our services immediately.

These Terms apply to all visitors, customers, and users of Digger Demolition, a demolition and excavating contractor based in Frederick, Maryland.

2. Description of Services

Digger Demolition provides professional contracting services to residential, commercial, industrial, and municipal clients, including:

Demolition Contracting

Full and partial structure demolition, heavy and technical demolition, selective demolition, interior strip-outs, house and garage demolition, and site preparation.

Excavating Contracting

Site excavation, grading, trenching, foundation excavation, pad preparation, road building, and earthmoving services.

Land Clearing

Lot clearing, forestry mulching, clearing and grubbing, tree and stump removal, brush and vegetation removal, and easement clearing.

Specialty Services

Concrete removal and crushing, pool removal, fence removal, pond work and stream restoration, erosion control and site restoration, hydraulic hammer rental, and trucking and hauling.

All services are subject to a scope-of-work agreement, site assessment, and applicable local, state, and federal regulations. Actual offerings may vary based on project requirements, site conditions, equipment availability, and permitting.

4. Eligibility & User Responsibilities

By using this Site or requesting services, you represent and warrant that you are at least 18 years of age, that you have legal authority to enter into agreements on behalf of yourself or any organization or property you represent, and that all information you provide is accurate and complete.

You agree to use this Site and our services only for lawful purposes and in compliance with all applicable local, state, and federal laws. You further agree not to damage, disable, or impair the Site or attempt unauthorized access to any systems or data connected to it.

5. Site Access, Estimates & Scheduling

All estimates, consultations, and site visits are subject to availability and must be scheduled in advance.

By scheduling with us, you agree to:

• Provide accurate contact and property information
• Ensure the job site is accessible at the scheduled time, including any gates, easements, or staging areas
• Disclose known site conditions, including underground utilities, septic systems, wells, hazardous materials, and structural concerns
• Understand that arrival windows are estimates subject to weather, traffic, and field conditions

Demolition and excavation work carries inherent risk from undisclosed conditions. Accurate disclosure protects both your project budget and our crews.

If site access is unavailable at the time of a scheduled visit, Digger Demolition reserves the right to reschedule and may assess a trip charge. We reserve the right to decline or reschedule any appointment at our sole discretion.

6. Cancellation Policy

Cancellations must be made at least [INSERT: 48] hours in advance. Cancellations with less notice may result in rescheduling delays, loss of scheduling priority, or a mobilization charge where equipment has already been staged or transported.

No-shows without prior notice may forfeit the scheduled slot.

Digger Demolition may also cancel or reschedule due to weather, unsafe site conditions, equipment issues, permit delays, or circumstances beyond our control. In those cases we will notify you as soon as reasonably possible and offer an alternative date.

7. Electronic Communications & E-Signature Consent

In accordance with the Electronic Signatures in Global and National Commerce Act (ESIGN Act), by using this Site or submitting any form you consent to receive communications electronically, including estimates, scheduling confirmations, change orders, project updates, and operational notices by email, text message, or through the Site.

You also consent to electronically sign or acknowledge documents, and such submissions carry the same legal validity as a physical signature.

You may request paper copies of any document by contacting info@diggerdemolition.com. You may withdraw consent to electronic communications at any time using the contact information in Section 19, though doing so may limit access to certain Site features or services.

8. SMS / Text Messaging Consent

By providing your mobile number to Digger Demolition, you consent to receive SMS messages related to service requests, estimates, appointment confirmations, and general operational communications.

Opt-In

Providing your number constitutes opt-in. Message frequency varies based on your engagement with our services.

Opt-Out

Reply STOP at any time to unsubscribe. One final confirmation message will be sent, and no further messages will follow unless you opt back in.

Disclaimers

Message and data rates may apply. Digger Demolition is not liable for carrier-related delivery failures. SMS consent is not a condition of receiving any service. This program covers operational communications only — no promotional messages will be sent without separate consent.

This program is intended to comply with the Telephone Consumer Protection Act (TCPA) and applicable carrier guidelines.

9. Service Limitations & Scope of Work

All services are governed by a written or verbal scope of work agreed upon before work begins. Services will be performed only as described in that agreed scope. Any additional work requires a separate agreement or written change order.

Site Conditions

Digger Demolition is not responsible for pre-existing site conditions, subsurface hazards, undisclosed or mismarked utilities, unstable soil or rock formations, or pre-existing damage, unless those conditions were identified during a formal site assessment and included in the agreed scope.

Hazardous Materials

Where asbestos, lead paint, or other regulated materials are present, abatement is handled under a separate scope and may require licensed specialty contractors. Testing and disclosure obligations remain with the property owner unless we agree otherwise in writing.

Permits and Compliance

Permits, zoning approvals, utility disconnections, and environmental requirements are the customer’s responsibility unless otherwise agreed in writing.

Safety

Digger Demolition reserves the right to halt, modify, or withdraw from work if unsafe conditions are discovered on site. Safety decisions made by our field leadership are final.

Nothing on this Site constitutes a binding service agreement, quote, or contract. All commitments must be confirmed in writing.

10. Warranties & General Disclaimers

DIGGER DEMOLITION PROVIDES THIS SITE AND ALL SERVICES “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that Site content is always accurate or current, that the Site will operate without errors or interruptions, or that our servers are free of harmful components. Reliance on any information obtained through this Site is at your own risk.

Digger Demolition reserves the right to modify or remove Site content at any time without notice.

This section governs the Site and general representations. It does not limit any workmanship warranty expressly provided in a signed service agreement.

16. Governing Law

These Terms are governed by the laws of the State of Maryland, without regard to conflict of law provisions. All legal proceedings shall be brought exclusively in the state or federal courts of Frederick County, Maryland, and you consent to personal jurisdiction in those courts.

17. Dispute Resolution

Before initiating any legal action, contact us at info@diggerdemolition.com to attempt informal resolution. We will make reasonable efforts to resolve the matter within 30 days.

If arbitration is adopted:] If the matter remains unresolved, disputes shall be submitted to binding arbitration under the rules of the American Arbitration Association in Frederick County, Maryland, before a single arbitrator whose decision is final and binding. Either party may seek injunctive relief in court to prevent irreparable harm. Rights to small claims court are not waived.

18. Modification of Terms

Digger Demolition may update these Terms at any time. Changes take effect upon posting, with the effective date updated accordingly. Continued use of this Site after changes are posted constitutes acceptance of the revised Terms. We will make reasonable efforts to notify you of material changes.
